On March 8, 2023, China acceded to the Hague Convention of October 5, 1961, Abolishing the Requirement of Legalization for Foreign Public Documents (“Hague Convention”). This international agreement marks an important milestone in China’s commitment to streamlining and simplifying the process of document authentication and legalization.
The Hague Convention, which will come into effect in Chinese mainland on November 7, 2023, ensures that the use of documents between China and other signatories to the Convention no longer requires authentication or legalization by embassies or consulates. This means that any public document issued by a signatory state and affixed with an apostille will be recognized as legally effective in China, and vice versa.
The accession to the Hague Convention will have significant implications for individuals and businesses involved in cross-border transactions, as it will greatly simplify the procedure of document verification. Previously, obtaining the necessary authentication and legalization for foreign public documents could be a time-consuming and expensive process. However, with China’s accession to the Convention, this burden will be lifted, making it easier for people to engage in international activities such as studying abroad, conducting business, or participating in legal proceedings.
It is worth noting that China is not alone in recognizing the value of the Hague Convention. Currently, more than 120 countries and regions worldwide have acceded to the Convention. This broad international acceptance further underscores the importance and effectiveness of this agreement in facilitating global cooperation and promoting the free movement of people and documents across borders.
In conclusion, China’s accession to the Hague Convention on the abolition of the requirement of legalization for foreign public documents marks a positive step towards harmonizing international document procedures and enhancing cross-border communication. This action demonstrates China’s commitment to facilitating international cooperation and promoting efficiency in legal processes.
